Bequests
(Sample language)

  • Unrestricted Gift
A gift that can be used where need or opportunity is greatest:
I hereby give and bequeath the sum of $_______* to Riley Children's Foundation, Indianapolis, Indiana for the Foundation's exempt purpose but without other restriction as to use.
  • Gift for a Specific Purpose:
I hereby give and bequeath the sum of $_______* to Riley Children's Foundation, Indianapolis, Indiana to be used for [state purpose].
  • Perpetual Endowment Fund
A gift that benefits us in perpetuity:
I hereby give and bequeath the sum of $_______* to Riley Children's Foundation, Indianapolis, Indiana for the Foundation's general endowment fund, but without other restriction as to use (or describe the specific purpose, if desired).
  • Residuary Bequest
Leaves any remainder after all other bequests have been paid:
I hereby give, devise and bequeth all of the rest of my property and estate remaining after the performance of the forgoing provisions of this will to Riley Children's Foundation, Indianapolis, Indiana for the Foundation's exempt purpose but without other restriction as to use.
  • Contingent Bequest
Takes effect only if a primary intention can't be met:
I hereby give, devise and bequeath all of the rest of my property and estate remaining after the performance of the forgoing provisions of this will to Riley Children's Foundation, Indianapolis, Indiana for the Foundation's exempt purpose but without other restriction as to use.
  • Safety Language
Language added whenever a gift is restricted:
In the event the purposes of the restriction, in the opinion of the Board of Governors of Riley Children's Foundation, can no longer be served, the Board may devote any remaining assets exclusively for charitable purposes that: (a) are within the scope of the charitable purposes of Riley Children's Foundation, and (b) most nearly approximate the original purpose of the gift.

* Rather than leaving a sum certain, you can include language that refers to a percentage of your estate or a description of the property you wish to give.
